Terms & Conditions of Sale
- BUYERS PREMIUM AND MASSACHUSETTS SALES TAX
–All purchases are subject to 6.25% Massachusetts Sales Tax,
unless Northfield Auctions, Inc. has been furnished with a valid
Sales Tax Resale Certificate. A 20% Buyer’s Premium, Discounted to 18% (Preferred) for Cash or Check will
be added to the selling price of each lot, as well as Massachusetts
Sale Tax, if applicable. Mastercard and
Visa are accepted. Not responsible for errors or omissions.
- NO GUARANTEES - Any reports, including printed
catalogs of sale, conversations with Northfield Auctions, Inc.
employees by telephone or in person, newspaper and flyer advertisements
and information furnished via the internet by Northfield Auctions,
Inc., are merely guides and/or opinions, furnished as a courtesy
to potential buyers, and are not to be considered or construed
as written or oral guarantees or warranties of condition or authenticity
of items presented for auction.
- ALL SALES FINAL-NO RETURNS - All items offered
at auction by Northfield Auctions, Inc. are available for preview
prior to the start of each auction. It is the responsibility of
all potential bidders to inspect the items that are of interest
to them and base their level of interest and/or bidding on their
own inspections. You, the bidder, are the final judge, jury and
executioner, and therefore, should not bid on any item(s) you
have not viewed and examined, as returns are not accepted by Northfield
Auctions, Inc. All items are sold as is without any guarantee
or warranty and with all faults. All weights and measurements
provided by Northfield Auctions, Inc. are approximate and provided
as a courtesy. Northfield Auctions, Inc. and its agents and employees
are not responsible for errors and omissions.
- AUCTIONEERS DISCRETION – The auctioneer
reserves the right to accept or reject any bid he/she feels is
not commensurate with the value of the lot being offered, or in
an increment not consistent with the bidding. If the auctioneer
has agreed to a confidential minimum reserve with a consignor
for a lot or lots, the auctioneer will execute the reserve on
behalf of the consignor in the manner he/she deems acceptable.
Northfield Auctions, Inc. reserves the right to withdraw any lot,
for any reason, at anytime deemed necessary.
- PAYMENT – All payments must be made in
U.S. currency the day of the auction unless prior arrangements
have been made with the auctioneer or his/her specified agent.
Cash only for Oriental rugs. Northfield Auctions, Inc. reserves
the right to hold items until payment has cleared. Any returned
checks will be subject to a $25.00 fee per return. Checks returned
and not made whole for the purchase price plus returned check
fee will be referred to the Northwest District Attorneys Office
of the Commonwealth of Massachusetts for collection and possible
prosecution. The buyer/bidder is responsible for purchases and
any and all fees incurred by Northfield Auctions, Inc. in the
collection process. Any bidder that has passed a bad check to
Northfield Auctions, Inc. is restricted to cash and/or credit
card payment for all future auction purchases (should the auctioneer
accept that bidders future bids). If the purchaser breaches any
of the obligations to pay in full the purchase price, plus buyer’s
premium and any storage, shipping and handling expenses, for which
he/she was the highest successful bidder, Northfield Auctions,
Inc. may exercise all of its rights and remedies under the law
including, without limitation; A) canceling the sale and applying
any payments made by the purchaser to the damages caused by the
purchasers breach and/or ; B) offering at public auction, without
reserve, any lot for which the purchaser has failed to pay for
in full, holding the purchaser liable for any deficiency plus
all costs of sale and collection of monies. Any legal disputes
arising from auctions conducted by Northfield Auctions, Inc. shall
be settled in the court system of the Commonwealth of Massachusetts.
- ABSENTEE BIDS – Absentee bids will be
executed by Northfield Auctions, Inc. for the convenience of the
customer. Northfield Auctions, Inc. will not be responsible for
any errors or failure to execute bids. A minimum of $20.00 is
required on each absentee bid. Absentee bids by person(s) unknown
to Northfield Auctions, Inc., (at the discretion of the Auctioneer
or his/her specified agent) require a credit card to secure the
bid(s). Credit cards are for the security of Northfield Auctions,
Inc. only and not the preferred method of payment. If, after 12
days, the successfully executed absentee bids have not been paid
in full by a method other than the secured credit card, said credit
card will be charged for the total of the purchase price(s) plus
a 20% buyers premium, and Massachusetts Sales Tax, if applicable.
Absentee bidders are fully responsible for any shipping, handling
or storage charges related to successful bids.
- PHONE BIDS – Phone bids must be pre-arranged
with the auctioneer at least 2 days prior to the start of the
auction. Phone bidders will be contacted at the pre-arranged time
by Northfield Auctions, Inc. Phone bidders give the employees
of Northfield Auctions, Inc the authority to make their bids known
to the auctioneer. Northfield Auctions, Inc. will not be responsible
for any errors, or failure to execute bids due to miscommunication,
inability to contact phone bidder, or loss of contact with phone
bidder due to equipment malfunction. Phone bids by person(s) unknown
to Northfield Auctions, Inc., (at the discretion of the Auctioneer
or his/her specified agent) require a credit card to secure the
bid(s). Credit cards are for the security of Northfield Auctions,
Inc. only and not the preferred method of payment. If, after 12
days, the successfully executed absentee bids have not been paid
in full by a method other than the secured credit card, said credit
card will be charged for the total of the purchase price(s) plus
a 20% buyers premium, and Massachusetts Sales Tax, if applicable.
Phone bidders are fully responsible for any shipping, handling
or storage charges related to successful bids.
- REMOVAL OF ITEMS PURCHASED - Northfield Auctions,
Inc., its auctioneers, or it employees will not be liable for
any injury, damage, or loss incurred in conjunction with the goods
sold at auction. Once the auctioneer has declared the item ‘sold’,
it is the sole responsibility of the buyer. Any items left at
Northfield Auctions, Inc. after the day of the auction in which
it was sold will be left solely at the risk and responsibility
of the purchaser. Northfield Auctions, Inc. will assume no liability
for theft, damage, or loss of any items. Lots must be picked up
in a reasonable period of time (no later than 14 days after the
sale) may be subject to storage fees of 3% of total purchase price
per month, or $50.00 per month, whichever is greater.
- SHIPPING - All items that require shipping
will be delivered to a local independent shipper. That shipper
will contact the buyer for payment of shipping and handling costs.
Northfield Auctions, Inc. will not be a party to the shipping
transactions and assumes no responsibility for the packaging,
shipping and handling of items shipped by the independent shipper.
Shipping transactions are between the buyer and the independent
shipper. Northfield Auctions, Inc. is not responsible for any
shipping fees or associated costs.
- BIDDING - Any bidding on items means you are
in compliance and acceptance of the terms of the sale as stated
herein. The bidder assumes all responsibility of the terms stated
upon bidding, including all terms and announcements or absentee
or phone bidding, and is responsible for all costs upon a successful
bid as stated above. We strongly urge you not to bid if you do
not agree to the terms and conditions stated above.
